Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Biegha marketplace platform ("Service"), operated by Biegha. By accessing or using Biegha, you agree to be bound by these Terms.

Biegha is a marketplace platform that enables users in Malta and Gozo to list items for sale and arrange local, in-person transactions with other users. Biegha does not participate in transactions between users and does not process payments for item sales.

2. Eligibility

You must be at least 18 years old to use Biegha. By creating an account, you represent that you meet this age requirement.

Professional sellers may be required to provide business registration details and comply with additional requirements.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms or our Community Guidelines.

4. Listings and Content

Sellers are responsible for the accuracy of their listings, including descriptions, photos, pricing, and condition. Listings must comply with our prohibited items policy and community guidelines.

You grant Biegha a non-exclusive licence to display your listing content on the platform. You retain ownership of your content.

5. Transactions

Biegha is a platform, not a party to transactions. All transactions occur directly between buyers and sellers. Biegha does not:

• Process payments for item purchases
• Hold funds in escrow
• Provide buyer or seller protection
• Guarantee item condition, delivery, or authenticity
• Ship or deliver items

Users are responsible for arranging payment, verifying items at collection, and resolving disputes directly with each other.

6. Paid Services

Biegha offers optional paid services including Boost (listing promotion) and Boost Plus (subscription). These are separate from transactions between users.

Payments for Biegha services are processed by Stripe and subject to Stripe's terms of service.

Refunds: Boost purchases are non-refundable once the boost period has started. Subscription cancellations take effect at the end of the current billing period. Contact support for refund requests.

7. Prohibited Conduct

You agree not to:

• List prohibited items or fraudulent listings
• Misrepresent item condition or details
• Harass, threaten, or abuse other users
• Create multiple accounts to evade restrictions
• Manipulate reviews or feedback
• Circumvent platform fees or policies
• Use automated tools to scrape or access the platform
• Violate applicable laws or third-party rights

8. Limitation of Liability

Biegha provides the platform "as is" without warranties of any kind. We are not liable for:

• Items listed, sold, or purchased through the platform
• Conduct of other users
• Accuracy or legality of listings
• Disputes between buyers and sellers
• Service interruptions or errors

To the maximum extent permitted by law, our total liability is limited to the amount you paid to Biegha for services in the preceding 12 months.

9. Governing Law

These Terms are governed by the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts. Nothing in these Terms affects your statutory rights as a consumer under EU law.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of Biegha after changes take effect constitutes acceptance of the updated Terms.
